MAHALO CAR SHARE LLC - RENTAL AGREEMENT
ACCEPTANCE OF TERMS AND CONDITIONS
By selecting the check mark provided herein, you acknowledge and agree to be bound by the terms and conditions outlined in this Rental Agreement ("Agreement"). Please read this Agreement carefully before proceeding with the rental.
PROHIBITED USE OF THE VEHICLE
The vehicle may not be used or operated by anyone:
Under 18 years of age.
Not listed as an additional driver on the rental agreement.
To carry persons or property for hire.
In any street race or similar contest.
In a careless or negligent manner.
Under the influence of alcohol or narcotics.
For any illegal purpose or to commit a crime.
If obtained from the lessor by fraud or misrepresentation.
On unpaved roads, except for graded private roads or driveways.
When loaded beyond its rated capacity.
With more passengers than available seat belts or the vehicle’s design capacity.
Violation of any prohibited use voids all liability and insurance coverage, making the renter fully responsible for all loss or damage, including but not limited to the lessor’s expenses and loss of use.
VEHICLE RETURN
Prior Authorization Required: You must contact Mahalo Car Share before your drop-off time/date to arrange the return.
Unauthorized Airport Drop-Off: A $250 fee will apply for unauthorized airport drop-offs. You may also be held liable for the full value of the vehicle.
Late Return Policy: A 30-minute grace period is allowed if you notify us in advance due to unforeseen delays (e.g., roadwork or accidents). After this, a $40 late fee will apply. Late returns disrupt operations and affect other renters, so punctuality and communication are essential.
CLEANING & FUEL
Cleaning: The vehicle must be returned clean and ready for the next rental. If returned dirty, a cleaning fee of up to $50 will be assessed based on the level of cleaning required.
Fuel: The vehicle will be delivered with a full tank and must be returned full. If not, the renter will be charged for refueling plus a $20 administrative fee. If the vehicle was received with less than a full tank, please email a photo of the fuel level to hold the previous renter responsible.
No Smoking: Smoking in the vehicle is strictly prohibited. Any signs of smoke odor or ash residue will result in a $250 cleaning fee.
RENTER RESPONSIBILITIES
Flat Tires & Battery Issues: The renter is responsible for flat tires caused by road hazards and battery-related problems.
Basic Maintenance (For Rentals Over 30 Days): Renters must maintain oil and water levels. Engine failure due to negligence may result in liability for repair costs (up to $1,000).
Mechanical Failure: If the vehicle overheats, turn it off immediately and contact Mahalo Car Share. Failure to do so may result in full liability for repair costs.
Parking & Traffic Violations: Renters are responsible for all fines, which should be paid immediately. If Mahalo Car Share pays the fine on your behalf, you will be charged the fine amount plus a $50 handling fee.
LOST KEYS & GLASS DAMAGE
Lost Keys: If Roadside Assistance is not purchased, assistance fees range from $100-$200 depending on location. After-hours assistance is 1.5x extra. Key replacement fees:
Regular keys: $150
Electronic keys: $250
Smart keys: $350
Broken Glass: Renters are responsible for broken glass unless caused by an accident where another party is at fault.
PAYMENT & CANCELLATION POLICY
Payment: Full payment is required at the time of booking online reservation.
Cancellation Fees:
48+ Hours Before Reservation: Full future store credit refund through promo code.
Less Than 24 Hours Notice: 50% cancellation fee.
No Notice: No refund.
No refunds after the rental begins.
RENTAL CHARGES & DAMAGE LIABILITY
Rental Charges: The rental period is billed in 16-hour increments. Taxes and surcharges apply. Overtime charges will be assessed accordingly.
Damage or Loss: The renter is responsible for all damage or loss, regardless of fault, including theft, collision, and vandalism, except for accidental fire, explosion, or natural disasters. Liability includes:
Repair costs or the car’s fair market value (whichever is less).
Loss of use charges based on reasonable downtime.
Towing and storage fees.
Insurance Claims: If the renter’s insurance or credit card covers damage, Mahalo Car Share must be provided with insurer details. Any excess amount collected will be refunded.
INSURANCE REQUIREMENTS
Standard Coverage: All vehicles come with third-party liability insurance meeting Hawaii’s minimum legal requirements.
U.S. Customers: Renters must maintain personal auto insurance covering:
Bodily injury & property damage liability
Personal injury protection (where required)
Uninsured/underinsured motorist coverage (where required)
Comprehensive & collision coverage
Primary vs. Secondary Coverage: Renter’s insurance is primary, and Mahalo Car Share’s coverage (if applicable) is secondary. Our policy applies only within the U.S.
Coverage Exclusions: Insurance will be void if the renter violates the agreement.
Claim Deductible: Insurance claims are subject to an excess of up to $1,000.
FINES & EXPENSES
Renters will pay all fines, court costs, and expenses for parking, traffic, and other violations.
A $30 administrative fee will apply for any violations incurred during the rental period.
Debit card renters will have a security deposit placed on their card.
GOVERNING LAW
This Agreement shall be governed by the laws of Hawaii. Any disputes will be resolved under Hawaii jurisdiction.
FINAL ACKNOWLEDGMENT
By selecting the check mark, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth in this Rental Agreement. If you do not agree with any part of this Agreement, do not proceed with the rental process.
